All pool construction is building work
Under the Act, building work includes constructing, altering, repairing or improving a swimming pool or spa. That captures new fibreglass and concrete pool installation, pool excavation where it is in the builder's scope, pool fencing construction, and pool concourse or paving done as part of a pool contract.
Because pool construction is building work, the builder must hold a current Building Work Contractor's licence regardless of the job value. The $20,000 figure governs contract and insurance obligations, not whether a licence is needed.
The licence categories that apply
A compliant pool build involves more than one licence.
- Building Work Contractor Licence (BWC) - the primary builder licence under the Act
- Registered Tradespeople licences for sub-trades such as concreters and tilers working under the BWC
- A current SA electrical worker licence for anyone doing electrical work on pool equipment
- A current SA plumbers licence for anyone installing pool plumbing
The $20,000 inc GST threshold
For residential building work over $20,000 inc GST - the threshold increased from $12,000 on 10 November 2025 - the Act requires a written contract with full scope, schedule and price, a deposit capped at 10% of the contract price, a 5 clear business day cooling-off period, and a progress payment schedule aligned to the stages of work.
Building Indemnity Insurance is mandatory for residential building work over the $20,000 threshold that exceeds 12 months in duration. Most pools build in 6 to 22 weeks, so it may not be triggered, but a licensed builder typically carries policy cover via a master policy.
How to verify a builder yourself
Verification is quick and it is the most important check you can do.
- Ask for the BLD number on the quote
- Go to cbs.sa.gov.au and open the Public Register
- Confirm the licence status reads Current
- Confirm the category covers Building Work Contractor
- Cross-check with the SPASA member directory
The penalties for unlicensed work
Operating unlicensed carries fines of up to $50,000 for an individual and up to $250,000 for a body corporate. More importantly for a homeowner: engaging an unlicensed builder can mean losing the protection of Building Indemnity Insurance and the residual rights of Australian Consumer Law.
